This Privacy/Data Protection Policy (“Privacy Policy”) is designed to help you understand how VeloxyIO, Inc. (“Veloxy” or “we” or “our” or “us”) collects and uses the information, including personal information and enterprise information (“Enterprise Information” such as CRM data, files, documents, emails, calendars, events, notes, tasks, contacts, and support data), that you submit, or Veloxy otherwise gathers, when you use Veloxy and its associated domains (“Site”), as well as the information, software or services available through the Site (“Services”). Except where otherwise expressly indicated in this Privacy Policy or on the Site, this Privacy Policy applies only to information collected on the Site and through the Services and does not apply to information that we receive off-line. Before submitting information to the Veloxy website (“Site”) or any of our applications (together with the Site, the “Service”), please review this Privacy Policy carefully. By using or accessing the Site or Services, and/or communicating with a Veloxy agent via mail, email or telephone you are accepting the practices described in this Privacy Policy. You are responsible for submitting accurate information to the Site. If you prefer that we not collect your personal information, please do not provide it to us. When you submit your personal and other information on the Site, you hereby consent to the collection, use and disclosure of such information as set forth in the Privacy Policy.

1. Information We Collect. Veloxy collects information that you share with us, including:

1.1 Personal Information: Personal Information is information that can personally identify you. We maintain one or more databases in the United States to store your Personal Information and may retain it as reasonably required to fulfill the purposes identified herein. Personal Information that we collect depends on how you use the Site. For example, if you register to use or use any of the Services or if you wish to contact us, we may collect your name, email address, information about other software that you use and the email addresses that you provide to us. If you download and use the Site and/or Services through a mobile device, Veloxy may collect information regarding the type of device you use, operating system version, the device identifier (or “UDID”), your IP addresses, and associated services from your mobile device. We ask for access or track any location-based information from your mobile device at any time while downloading or using our Application. We send you push notifications through our mobile application. You may at any time opt-out from receiving these types of communications by turning them off at the device level through your settings. Providing your Personal Information to us is your choice. If you choose not to provide us with certain Personal Information, you may not be able to take advantage of certain features of the Site and Services.

1.2 Information You Authorize Us to Collect: Certain features of the Service may allow you to import information from third party services (such as Salesforce, Google, Microsoft, LinkedIn, Twitter, Zendesk, etc.) (“Third Party Services”). By requesting that Veloxy import such information – you authorize Veloxy to use your Third Party Service username and password to access the applicable Third Party Service Account. This authentication process is managed by the applicable Third Party Service provider. Veloxy will not use your Third Party Service account credentials for any other purpose. Veloxy collects and logs phone call data (who, where, when and how long) to improve services we offer you, and our analytics.

1.3 General Information: When you visit the Site, we may collect various categories of general non-personal information (“General Information”). General Information includes browser information, operating system information, and the date, time, length of stay and specific pages accessed during your visits to the Site. When possible, General Information may be linked to Personal Information. We do this to improve services we offer you, and our analytics. We also may collect information from the people with whom you interact by email when you use the Site and Services. You acknowledge and agree that you will not (a) provide us with any information that you do not have the right to provide, or (b) share, via the Service, any information you do not have the right to share (such as information that is confidential to any third party and that you are not authorized to share with your intended recipients).

1.4 Cookies and Other Online Identification Tools: “Cookies” are identifiers we transfer to your browser or device that allow us to recognize your browser or device and tell us how and when pages and features in our Service are visited and by how many people. You may be able to change the preferences on your browser or device to prevent or limit your device’s acceptance of cookies, but this may prevent you from taking advantage of some of our features. Our advertising partners may also transmit cookies to your browser or device, when you click on ads that appear on the Service. Also, if you click on a link to a third party website or service, such third party may also transmit cookies to you. Again, this Privacy Policy does not cover the use of cookies by any third parties, and we aren’t responsible for their privacy policies and practices. When we collect the usage information described here, we only use this data in aggregate form, and not in a manner that would identify you personally. For example, this aggregate data can tell us how often users use a particular feature of the Service, and we can use that knowledge to make the Service interesting to as many users as possible.

1.5 Automatically Collected Information: We may automatically receive and store certain, anonymous types of information whenever you interact with the Service. Such information may include your IP address, domain server, and type of Internet browser. This information helps us, among other things, analyze trends and administer the Service. This information is anonymous and contains no personally identifiable data.

1.6 Mobile Analytics: We use mobile analytics software (like Google Analytics) to allow us to better understand the functionality of our Mobile Software on your phone. This software may record information such as how often you use the application, the events that occur within the application, aggregated usage, performance data, and where the application was downloaded from. We do not link the information we store within the analytics software to any Personal Information you submit within the mobile app.

2. Disclosure of the Information That We Collect. Unless you have consented or as otherwise described in this Privacy Policy, we neither rent nor sell your Information to anyone. We share your Information only as described below.

2.1 Within Your Organization: Certain of your Enterprise Information may be shared internally with other members of your organization.

2.2 Affiliates: We may share your information with our affiliates, including, but not limited to, our strategic business partners, who may use your information for purposes similar to the purposes for which Veloxy collects such information. Veloxy requires all such companies to comply with the terms of this Privacy Policy.

2.3 Sale or Transfer of Information: In the event of a sale, merger, liquidation, dissolution or sale or transfer of substantially all of the assets of Veloxy or the Site, Personal Information and/or other information collected through the Site may be sold, assigned or transferred to the party acquiring all or substantially all of the equity and/or assets of Veloxy, the Site and/or Services. In the unlikely event of an insolvency, bankruptcy or receivership, your information also may be transferred as a business asset. By using the Site and Services and submitting your information to us, you consent to the sale and transfer of your information as described here. You will be notified via email and/or a prominent notice on our Site of any change in ownership or uses of your personal information, as well as any choices you may have regarding your personal information.

2.4 Compliance with Law and Fraud Protection: We may disclose any information, including, without limitation, Personal Information, we deem necessary, in our sole discretion and without your prior permission, to comply with any applicable law such as to comply with a subpoena, regulation, binding orders of a data protection agency, legal process or governmental request. Veloxy reserves the right to disclose your Personal Information if we believe you have or are violating our Terms of Use or in order to protect or defend Veloxy’s rights or property, even without a subpoena, warrant or other court order We may also use your information in following ways: To provide you with the new features and benefits of the Service. To provide you with notices relate to your use of the Service. To provide you with promotional and marketing emails. You can opt-out of receiving certain types of promotional and marketing emails – but in such case you may not receive the full benefit of the Service. To help personalize the Service experience for you.

3. Controlling Your Personal Information.

3.1 Deleting your account: You can delete your account by sending an email to support@veloxy.io. Subject to the “Limitations on Deletion” section below, when you request us to delete your account for the Service, your data will be permanently deleted from our servers and access to your account will be disabled.

3.2 Limitations on Deletion: Even after you delete your account, your Information may be retained by us on back-up servers indefinitely. We keep such servers to help protect the stability and availability of the Service. In addition, copies of your information may remain viewable elsewhere to the extent it has been publicly published by you or otherwise shared by you with others. We may also retain certain information to prevent identity theft and other misconduct even if deletion has been requested. We may also indefinitely retain and use any aggregated data derived from your Information after you delete it, but not in a manner that would identify you personally.

3.3 Laws and Regulations: We may also retain your Information to the extent required to comply with any laws or regulations. 3.4 California Residents: California law (California Civil Code Sections 1798.83-1798.84) permits individuals who provide Veloxy with Personal Information and who are California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. Veloxy does not, at this time, disclose Personal Information to third parties for their direct marketing purposes. If Veloxy changes this policy, we will update this provision and provide instructions on how you may make a request for details concerning such information.

4. Security. Veloxy has implemented technical, administrative and physical security measures to protect your information from unauthorized access. While Veloxy strives to protect your information, no data transmission over the Internet is 100% secure and, consequently, we cannot ensure the security of any information. When you enter any information on our order forms, we encrypt the transmission of that information using secure socket layer technology (SSL).

5. Users Outside of the United States. The Site is hosted in the United States and is governed by United States law. If you are outside the United States when you visit the Site or engage in communications with a Veloxy agent via mail, e-mail or telephone, please be aware that your information may be transferred to, stored and processed in the United States where our servers are located. The data protection and other laws of the United States and other countries might not be as comprehensive as those in your country. By using the Site and/or communicating with a Veloxy agent via mail, email or telephone, you consent to your information being transferred to our facilities in the United States and to the facilities of those third parties with whom we share it as described in this Privacy Policy.
